This is a Pilot Travel Centers LLC (PTC) Computer System. Introduction

• The types of information we may collect or that you may provide when you register for, access or use the Company's Infor system (hereinafter "Infor").
• Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect through Infor and in email, text, and other electronic communications sent provided through Infor or in connection with Infor.

This policy DOES NOT apply to information that:

• We collect offline or on any other Company apps or websites, including websites you may access through Infor which will be subject to their own terms and conditions.
• You provide to or is collected by any third party.

Our websites and apps, and these third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, provide information to or otherwise use Infor. By accessing, registering with, providing information to or otherwise using Infor, you agree to this policy. This policy may change from time to time. Your continued use of Infor after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children Under the Age of 13

Infor is not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Information We Collect and How We Collect It

• Directly from you when you provide it to the Company in relation to your hiring and continued employment.
• Directly from you when you provide it to the Company or its agents in relation to employment benefits offered by the Company.
• Directly from your Company location in relation to your employment status, your position qualifications and certifications, your role, your job functions, your job duties, your job schedule and your hours worked.
• Directly from you when you provide it to the Company.
• Directly from you when you provide it through Infor.
• Automatically when you use Infor.

Information You Provide to Company

• By which you may be personally identified, such as name, postal address, email address, telephone number, position with the Company, store location, certifications ("personal information").

• Information that you provide by filling in forms in Infor. This includes information provided at the time of registering to use Infor. We may also ask you for information when you report a problem with Infor or make inquiries through Infor.
• Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
• Your responses to Company surveys that we might ask you to complete for research purposes.
• Details related to training you have completed.
• Details related to hours worked, work schedule, payroll, paystubs, and tenure.
• Details of transactions you carry out through Infor.
• Your search queries on Infor.
• Any other information you choose to provide to the Company using Infor.

You may provide information to be published or displayed ("Posted") on public areas of Infor (collectively, "User Contributions") that would be viewable by other Company Users utilizing Infor and accessing the public areas. Your User Contributions are Posted and transmitted to others at your own risk. Although you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Automatic Information Collection [and Tracking]

• Usage Details. When you access and use Infor, we may automatically collect certain details of your access to and use of Infor, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through Infor. Location data may include collection and verification of the IP address being utilized to access Infor for the purpose of verifying whether the User is permitted to clock-in for work purposes through Infor at that time. Users not utilizing an IP address belonging to or related to a Company location will be unable to use Infor to clock-in when such functionality is offered.
• Device Information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.
• Stored Information and Files. If shared by User, Infor may access other information associated with other files stored on your device. This may include, for example, photographs and audio and video clips explicitly uploaded or shared by User Users should never upload personal information related to third parties not affiliated with Company.
• Location Information. Infor may collect real-time information about the location of your device. Location data may include collection and verification of the IP address being utilized to access Infor for the purpose of verifying whether the User is permitted to clock-in for work purposes through Infor at that time. Users not utilizing an IP address belonging to or related to a Company location will be unable to use Infor to clock-in when such functionality is offered.

If you do not want us to collect this information do not opt-in to utilization of Infor or, if you choose to opt out at a later time, you may opt out at any time by emailing Infor.Help@pilotravelcenters.com or contacting the Infor Administrator via mail at Pilot Travel Centers LLC, 5508 Lonas Dr., Knoxville, TN 37909..

Information Collection Technologies

• Cookies (or mobile cookies). A cookie is a small file placed on your smartphone/device. It may be possible to refuse to accept cookies by activating the appropriate setting on your smartphone/device. However, if you select this setting you may be unable to access certain parts of Infor.
• Web Beacons. Pages of Infor and the Company's emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for collecting other related Infor usage statistics (for example, recording the popularity of certain content and verifying system and server integrity).

Third-Party Information Collection

• Your mobile device manufacturer.
• Your mobile service provider.

These third parties may use tracking technologies to collect information about you when you use Infor. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Use Your Information

• Provide you with Infor and its contents, and any other information that you request from the Company.
• Fulfill any other purpose which is disclosed to you and to which you consent.
• Give you notices about your employment with us, including scheduling, hours worked, payroll information, frequently asked questions, policies, and benefits.
• To supply you with other information you have requested.
• Notify you when Infor updates are available, and of changes to any products or services we offer or provide though it.
• To carry out any other purpose permitted or required by law.

• Estimate our audience size and usage patterns.
• Store information about your preferences, allowing us to customize Infor according to your and other Team Member interests.
• Speed up searches.
• Recognize you when you use Infor.

Disclosure of Your Information

We may disclose information that does not identify any individual or device, without restriction.

• To our subsidiaries and affiliates for purposes related solely to your employment with the Company and when specifically requested by User.
• To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Pilot Travel Centers LLC's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Pilot Travel Centers LLC about Infor users is among the assets transferred.
• To third parties to market their products or services to you if you have consented to these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.
• To fulfill the purpose for which you provide it.
• For any other purpose disclosed by us when you provide the information.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.

• Contact by the Company. While the Company does not intend to share your information with third parties for the purpose of interest-based advertising without specific consent from User, Company does not control the third party collection or use of your information to serve interest-based advertising when such information is collected by entities or through usage unaffiliated with Infor. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Accessing and Correcting Your Personal Information

You can review and change certain portions of your personal information by logging into Infor and visiting your account profile page.

You may also send us an email at Infor.Help@pilottravelcenters.com to request access to, correct, or delete any of your personal information that we hold. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. We may require you to verify your identity before we provide you with access to your personal information. We will endeavour to comply with your request; however, in some cases we may not be able to allow you to access certain personal information in certain circumstances, for example if it contains personal information of other persons, or for legal reasons. In such cases, we will provide you with an explanation of why it is not possible to grant access to your personal information.

If you delete your User Contributions from Infor, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Infor users.

Your California Privacy Rights

California Civil Code Section 1798.83 permits users of Infor that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Data Security

We have implemented security measures, including physical, technological and organizational safeguards, designed to help secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of Infor, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of Infor like Ming.le or message boards. The information you share in public areas may be viewed by any user of Infor.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through Infor. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Some or all of the personal information we collect may be stored or processed on servers located outside your jurisdiction of residence, including in the United States and Canada, whose data protection laws may differ from the jurisdiction in which you live. As a result, this information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions.

Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users' personal information, we will post the new privacy policy on this page with a notice that the privacy policy has been updated and we may notify you by email and/or text message to the primary email address and/or phone number specified in your account in-Infor alert the first time you use Infor after we make the change.

Use of Infor

Infor is the property of the Company. You are granted a revocable, non-exclusive, non-transferable limited license to use Infor in relation to your employment with Company, including but limited to accessing information about your employment, your role, your job functions, your job duties, view available offers from Pilot, learn about the general business affairs of Pilot, and to access and view Infor and to print off copies of any or all of the pages of Infor, provided (a) it is used only for informational, non-commercial purposes, and (b) you do not remove or obscure the copyright notice or other notices. Without the express written consent of Company, you are not allowed (i) to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, products or services obtained from Infor; (ii) to reproduce any part of Infor or mirror any material contained on Infor on any other server; or (iii) to link to or from Infor. You agree not to circumvent, attempt to circumvent or permit others to circumvent any access controls or security measures or features we place on Infor.

Infor requires the creation of an account and sign-on credentials for use. User is responsible for maintaining the active status of those sign-on credentials, the security of those sign-on credentials and for all activities taken using the credentials.

The Company reserves the right, at its discretion, to refuse access to Infor or to take any other appropriate action if it believes that a visitor's conduct is in violation of applicable law or these terms and conditions.

Trademarks

PILOT TRAVEL CENTERS, PTC, PILOT, PILOT CORPORATION, FLYING J, PILOT FLYING J, FREQUENT FUELER ADVANTAGE, CRAZEE ABOUT COFFEE, and TRUCKERS FOR TOTS are all marks owned by The Company and may not be used without the express written permission of the Company. There are other trademarks, service marks, trade names and trade dress on Infor owned by the Company, or other entities. All marks are and shall remain the sole and exclusive property of their respective owner(s). You may not use any Company trademarks, service marks, trade names or trade dress without the express written permission of the Company, or the applicable owner.

The Company uses trademarks, service marks, logos, graphics, designs, names, and the like from third parties for display on Infor. Such posting is done with the permission of these third parties, and such materials are to be considered the exclusive property of the respective third parties.

Copyrights

All software and content included on Infor, including all text, graphics, logos and images, is owned by the Company or third parties and is protected by United States, Canadian, and international copyright laws. You may view and use the content of Infor in connection with your use of Infor in compliance with these terms and conditions and all applicable law. Any other use, including the reproduction, copying, distribution, transmission, republication, display or creation of works derivative of the content of Infor is strictly prohibited, except as otherwise specifically set forth herein. You do not acquire ownership rights to any content or other materials viewed on or through Infor. The posting of information or materials on Infor does not constitute a waiver of any rights therein. You may not (and you may not permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract any source code of Infor or any part thereof, unless this is expressly permitted or required by law, or unless you have been granted written permission to do so by the Company.

Indemnity

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS, (COLLECTIVELY THE �RELEASEES�) HARMLESS FROM AND AGAINST ANY CLAIMS, ACTIONS, DEMANDS, COSTS, DAMAGES, LIABILITIES AND SETTLEMENTS INCLUDING WITHOUT LIMITATION, REASONABLE LEGAL AND ACCOUNTING FEES, RESULTING FROM, OR ALLEGED TO RESULT FROM, YOUR VIOLATION OF THIS AGREEMENT OR THE COMPANY PRIVACY POLICY, YOUR USE OF INFOR, OR YOUR VIOLATION OF THE RIGHTS OF ANY THIRD PARTY.

Limitation of Liability

THE RELEASEES WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, WHETHER DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES OF ANY KIND WHATSOEVER, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, ARISING FROM THE USE OF INFOR OR SERVICES AVAILABLE ON INFOR, THE UNAVAILABILITY OF INFOR, DAMAGE TO YOUR COMPUTER, DEVICE, OR COMPUTER SYSTEM, OR ANY LOSS OF DATA OR BUSINESS INTERRUPTION RESULTING FROM SUCH USE, EVEN IF THE RELEASEES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF INFOR OR WITH ANY OF THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING INFOR AND ANY SERVICES OR PROGRAMS PROVIDED THROUGH INFOR.

THE NEGATION OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND THE COMPANY. INFOR WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM INFOR OR OTHERWISE SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THIS AGREEMENT.

Termination

If you breach any provision of these terms and conditions or our Privacy Policy, you may no longer use Infor. We may, in our sole discretion, change, suspend or terminate, temporarily or permanently, Infor or any part thereof or any of its features at any time, for any reason, without any notice or liability to you or any other entity. If these terms and conditions or your permission to use Infor is terminated by us for any reason, the agreement formed by your acceptance of these terms and conditions will nevertheless continue to apply and be binding upon you in respect of your prior use of Infor and anything relating to or arising from such use. The Disclaimer, Indemnity and Limitation of Liability provisions in these terms and conditions shall survive any termination of this agreement.

General

If any provision of these terms and conditions is held invalid or unenforceable by any court having competent jurisdiction, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions of these terms and conditions shall continue in full force and effect. No failure to exercise or waiver of any provision of these terms and conditions shall be deemed a further or continuing waiver of such provision or any other provision of these terms and conditions.
